At O’Brien & Eggleston PLLC, our Albany criminal defense attorneys know a sex crime conviction in New York can have many consequences. The first and most obvious is — depending on the sex crime, the circumstances of the crime, and your criminal history — an extended jail sentence that takes away your freedom and significantly limits your future options.

Here, our Albany County defense lawyers discuss some of the ways a sex crime conviction can impact your life.

New York Sex Crime Conviction Can Impact Your Future

What are the Penalties Associated with Sex Crime Convictions in New York?

New York’s sentencing laws require judges to impose determinate (fixed) sentences for felony sex offenses. For example, a Class B felony is punishable by five to 25 years in prison.

Other consequences of a sex crime conviction include:

Fines and penalties.

Court-ordered counseling and therapy.

Criminal record.

In addition, sex offenders must register with the New York Division of Criminal Justice Services under one of three risk levels:

  • Level 1: Low risk of repeat offense.
  • Level 2 Moderate risk of repeat offense.
  • Level 3: High risk of repeat offense and a threat to public safety exists.

The New York Sex Offender Registry can be searched by anyone with an internet connection, which means your listing can be viewed by just about anyone. The length of registration depends on the charges but can be a minimum of 20 years or even for life. Not registering correctly can lead to additional felony charges.

Registration can lead to social disgrace, loss of relationships and jobs, future employment restrictions, school enrollment, housing, and both verbal and physical assaults.

In addition, if you are required to submit to the sex offender registry,  the reporting burdens and overall compliance requirements can be very stringent and stressful.
